Workshop at the ADJA on "Guidelines for Issuing Payment Orders in Commercial Matters"


The Abu Dhabi Judicial Academy (ADJA) organized a workshop on the "Guidelines for the Issuance of Payment Orders in Commercial Matters", through the Academy's training platform; with the participation of 207 judges and officers of the court from the Abu Dhabi Judicial Department (ADJD), in addition to lawyers registered on the ADJD’s roster.

 

The Judicial Academy explained that the workshop, which lasted 3 days, was organized in implementation of the directives of His Highness Sheikh Mansour bin Zayed Al Nahyan, Deputy Prime Minister, Minister of Presidential Affairs and President of the Abu Dhabi Judicial Department, to work towards the improvement of judicial performance by providing specialized and continuous training to members of the judiciary and officers of the court.

 

The workshop is also part of the training plan approved by His Excellency Youssef Saeed Al Abri, Undersecretary of the Judicial Department, which involves workshops and training courses for judges from all chambers to keep abreast of legislative and judicial developments at all local, regional and global levels.

 

During the opening speech of the workshop, the consultant Ali Al Shaer Al Dhaheri, Director of the Judicial Inspection Division at the Judicial Department, delivered a welcome address to the participants. He explained that the workshop aimed at enriching the legal and judicial deliberative thinking of the participants and unifying the approaches towards the payment orders system in commercial matters in line with international standards of competitiveness, so as to contribute to the improvement of the business environment in the emirate of Abu Dhabi and consolidate its position as an attractive environment for foreign investment and capital.

 

He also referred to the expected role of the new guidelines in activating accomplished, fair and simplified litigation systems and the provision of fast and effective mechanisms for dispute resolution, to ensure that investors can easily access justice and quickly recover their rights, to ultimately speed up the capital turnover and ensure the regularity of economic and commercial activities.

 

For his part, Consultant Sultan Al Neyadi, Head of the Abu Dhabi Commercial Court, who acted as the workshop's activities moderator, explained that the payment orders system is one of the fundamental systems for the full recovery of the rights and the reinforcement of judicial efficiency standards, on which the Emirati legislator insisted in line with the legislative development of Federal Law No. (11) of 1992 relating to civil procedure, and also in line with Cabinet Resolution No. 57 of 2018 relating to the Executive Regulation of the Civil Procedure Law.

 

It should be noted that the workshop was held over three days: the first day was dedicated to members of the judiciary, the second day to lawyers registered with the Judicial Department, while the third day was allocated to the officers of the court. Fahad Al-Tamimi, judge at the Commercial Court, addressed the workshop and highlighted the objectives of issuing these guidelines for payment orders and the general and specific conditions for issuing payment orders. He also provided a detailed explanation of the criteria for determining the payment requirement, the conditions for obtaining expedited enforcement, in addition to the conditions and controls for the referral of the case in which the conditions of the payment order are fulfilled.
